These Terms and Conditions (“Terms”) govern your access to and use of the BHLW application and services (the “App”), provided by BHLW (“we,” “us,” or “our”). Please read these Terms carefully. By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

## 1. Eligibility

You must be at least 13 years old (or 16 in the EEA) to use the App. By using the App, you represent and warrant that:

You meet the applicable minimum age requirement
You have the legal capacity to enter into a binding agreement
You are not prohibited from using the App under applicable law

## 2. Account Registration

You must provide accurate, current, and complete information during registration.
You are responsible for maintaining the confidentiality of your account credentials.
You must notify us immediately if you suspect unauthorized access to your account.
You may not share your account with others or create accounts on behalf of third parties without authorization.
We reserve the right to suspend or terminate accounts that violate these Terms.

## 3. License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the BHLW App for your personal, non-commercial purposes. This license does not include the right to:

Sublicense, sell, rent, lease, or transfer the App
Modify, adapt, translate, reverse-engineer, or create derivative works
Remove or alter any proprietary notices or labels
Use the App for any commercial purpose without our written consent

## 4. User Content

### 4.1 Your Content

You retain ownership of any content you submit, post, or upload to the App (“User Content”). By submitting User Content, you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, distribute, and display that content solely to operate and improve the App.

### 4.2 Content Standards

You agree not to post User Content that:

Is unlawful, defamatory, obscene, pornographic, or harassing
Infringes any third party’s intellectual property or privacy rights
Contains viruses, malware, or harmful code
Promotes violence, discrimination, or illegal activities
Is misleading, fraudulent, or constitutes spam

We reserve the right to remove any User Content that violates these standards, without notice.

## 5. Prohibited Activities

In addition to content restrictions, you agree not to:

Use the App to violate any applicable law or regulation
Attempt to gain unauthorized access to any part of the App or its infrastructure
Use automated tools, bots, or scrapers to access or collect data from the App
Interfere with or disrupt the App’s servers or networks
Impersonate any person or entity
Engage in any activity that could harm other users
Circumvent security features or access controls

## 6. Intellectual Property

The App and its original content (excluding User Content), features, functionality, design, logos, and trademarks are owned by BHLW and are protected by copyright, trademark, and other intellectual property laws. You may not use our intellectual property without prior written permission.

## 7. In-App Purchases

Certain content or features are available as one-time in-app purchases. All prices are shown in the App before you buy and are exclusive of applicable taxes.
Purchases are one-time and do not auto-renew. The App does not offer subscriptions.
Purchases are processed by the applicable app store (Google Play Store or Apple App Store), which handles your payment.
Refunds are subject to the refund policy of the applicable app store.
We reserve the right to change pricing with reasonable notice; changes do not affect purchases already completed.

## 8. Third-Party Services and Links

The App may contain links to third-party websites or integrate with third-party services. We are not responsible for the content, privacy practices, or terms of those third parties. Your use of third-party services is governed solely by their respective terms and policies.

## 9. Disclaimers

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

## 10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BHLW AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

## 11. Indemnification

You agree to indemnify, defend, and hold harmless BHLW and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the App; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another person or entity.

## 12. Termination

We may suspend or terminate your access to the App at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, all licenses granted to you will immediately cease. You may delete your account at any time through the App settings. Provisions that by their nature should survive termination shall survive, including Sections 6, 9, 10, 11, and 13.

## 13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA (or the jurisdiction of your country of residence, if required by local law), without regard to its conflict of law provisions.

Any dispute arising from these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), except that either party may seek injunctive relief in a court of competent jurisdiction. Class action waiver: you and we agree that any dispute resolution proceedings will be conducted on an individual basis only.

## 14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a prominent notice in the App, with at least 14 days’ notice before the changes take effect. Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms.

## 15. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
Severability: If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
Waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right.
Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights freely.
Force Majeure: We shall not be liable for delays or failures caused by circumstances beyond our reasonable control.
